Wheeler, Brown, Kirgis, and Welsh on Negotiation Pedagogy

At last spring’s ABA Legal Educators’ Colloquium, I led a panel with Nancy Welsh and Jennifer Brown on teaching distributive negotiation. The papers that developed out of that panel, along with an additional piece by Michael Wheeler, have now been published in the new issue of the Negotiation Journal.

Mike leads off by making the case for teaching distributive bargaining and then introduces the three other pieces. Jennifer then explains how the Thomas-Kilman Instrument can be used help students become more comfortable in value-claiming situations. In my piece, I assess techniques for exposing students to hard bargaining through the use of a variety of simulations. Finally, Nancy explains her use of a reputation index to help students understand how perceptions of competence, effectiveness, trustworthiness, and integrity contribute to their reputations as negotiators.
