Franken Reintroduces Arbitration Fairness Act

While I am not suprised by the Act’s reintroduction, its broad coverage, eliminating pre-dispute arbitration agreements for consumer, franchise and employment disputes, is not headed for likely passage. In light of Concepcion, it would be better to redraft the act to address the major issue in arbitration today — the inability of consumers with low value claims to vindicate those claims in a class process.
